Our client had experienced an ectopic pregnancy previously, which had resulted in her undergoing a salpingectomy and removal of a fallopian tube.
A year later, following a positive pregnancy test, the woman was referred by her GP to the Early Pregnancy Assessment Centre at Yeovil District Hospital. Her GP was worried she was having another ectopic pregnancy as her symptoms were similar to those she had previously experienced.
An ultrasound scan proved inconclusive but a pregnancy test showed a faint line. The nurse at Yeovil District Hospital believed that she was suffering a miscarriage and asked her to return the following week.
The pregnancy test was still positive when she returned. Bloods were taken and she was advised to go back several days later for further tests. When she did so a decision was taken to surgically remove another ectopic pregnancy.
Due to excessive bleeding a salpingectomy on the other side had to be performed.
She consulted our specialist medical negligence team which has been rated number one for medical negligence law in Taunton by the trusted legal review website, ReviewSolicitors*. We agreed to pursue an ectopic pregnancy compensation claim on the basis there had been a negligent delay in diagnosing the ectopic pregnancy, and offered to work under a no win, no fee agreement.
We submitted the ectopic pregnancy claim to Yeovil District Hospital. The NHS Trust conducted an investigations into the circumstances of the case and the allegations of negligence that had been made. This resulted in the Trust making a full and open admission of liability.
We then entered into settlement negotiations with the Trust. This resulted in an out of court agreement being reached for a compensation package that included payment of our client’s legal costs.
